These Terms of Service apply when you visit, use or make a purchase from Clark’s Creations through our website, clarks-creations.co.uk.

By placing an order with Clark’s Creations, you agree to these Terms of Service. Please read them carefully before purchasing.

Nothing in these terms affects your statutory rights as a consumer under UK law.

About Clark’s Creations

Clark’s Creations is a UK-based small business offering personalised, made-to-order gifts, clothing, keepsakes, drinkware, accessories and other products.

Our online store is hosted by Shopify, which provides the ecommerce platform used to display and sell our products.

Using Our Website

You may use our website for lawful personal shopping purposes.

You must not:

• Use the website for fraudulent or unlawful purposes.
• Attempt to interfere with the security or operation of the website.
• Copy, reproduce or commercially use our product photographs, descriptions, designs or other website content without permission.
• Submit material that is unlawful, offensive, abusive or infringes another person's rights.

We may restrict access to the website where reasonably necessary to protect our business, customers or website security.

Products

We make every reasonable effort to describe and photograph our products accurately.

Because many Clark’s Creations products are handmade, personalised or made to order, there may occasionally be small differences between photographs and the finished item.

Colours may also appear slightly different depending on your screen, device or display settings.

These minor variations do not normally mean that a product is faulty.

Personalised and Made-to-Order Products

Many of our products are created specifically for each customer.

When ordering a personalised product, you are responsible for checking all information you provide, including:

• Names and spellings.
• Dates.
• Sizes.
• Colours.
• Design choices.
• Photographs.
• Messages or wording.
• Any other personalisation details requested on the product page.

Personalisation will normally be produced exactly as submitted.

Clark’s Creations cannot be responsible for mistakes contained in information supplied or approved by the customer.

If you notice an error after placing an order, please contact us as soon as possible. We will try to make changes where production has not yet started, but changes cannot be guaranteed once work has begun.

Customer-Supplied Photographs and Designs

Where you upload or provide a photograph, image, logo, wording or design for use on a personalised product, you confirm that you have permission to use that material.

If the photograph contains another person, including a child, you confirm that you have the appropriate authority or permission to provide the photograph for the purpose of creating the product.

You must not submit material that infringes copyright, trademarks or another person's legal rights.

We may refuse an order containing material that we reasonably believe is unlawful, inappropriate or infringes the rights of another person.

Orders

After placing an order, you will receive confirmation through the contact details provided during checkout.

Please check your order confirmation carefully.

We reserve the right to decline or cancel an order where there is a genuine reason to do so, including:

• A clear pricing or website error.
• An item or material unexpectedly becoming unavailable.
• Personalisation that we are unable to produce.
• Suspected fraudulent activity.
• A request involving unlawful or inappropriate material.

If we cancel an order after payment has been taken, you will receive a full refund for the cancelled item or order.

Prices and Payment

All prices are displayed in pounds sterling (£) unless otherwise stated.

The price payable is the price shown when your order is placed, including any personalisation options or additional extras selected.

Payment must be successfully completed before we begin producing your order unless otherwise agreed.

Payments are processed securely through Shopify and the payment provider selected at checkout.

If an obvious pricing error is discovered before your order is produced or dispatched, we will contact you. You may choose to proceed at the correct price or cancel the affected item for a full refund.

Turnaround Times

Most Clark’s Creations products are made to order.

The current estimated turnaround time will be displayed on our website, product information or communicated to you when ordering.

Turnaround times are estimates rather than guaranteed delivery dates.

During busy periods, seasonal launches, school holidays or unusually high order volumes, turnaround times may be longer. Where possible, we will keep customers informed of significant delays.

If you require an item for a particular date, please contact us before ordering so we can confirm whether this is achievable.

Delivery

Available delivery options and charges will be shown at checkout.

Please ensure that your delivery address is complete and accurate before placing your order.

Clark’s Creations cannot normally be responsible for delays or additional costs caused by an incorrect or incomplete address supplied by the customer.

Once an order has been dispatched, delivery times may be affected by the postal or courier service used.

If an order appears to be lost or significantly delayed, please contact us so that we can investigate.

Collection

Where local collection is offered, collection arrangements will be provided privately.

Please do not travel to collect an order until you have received confirmation that it is ready.

Cancelling Personalised Orders

The usual 14-day change-of-mind cancellation right for online purchases does not normally apply to products that are personalised, custom-made or made to your individual specifications.

If you contact us before production has started, we may be able to cancel or amend your order, but this cannot be guaranteed.

Your rights regarding products that are faulty, damaged, not as described or incorrectly produced by us are not affected.

Non-Personalised Products

If you purchase a standard non-personalised product, you may have additional cancellation and return rights under UK consumer law.

Faulty, Damaged or Incorrect Items

We want you to be happy with your order.

If an item arrives faulty, damaged, not as described or has been personalised incorrectly by Clark’s Creations, please contact us as soon as possible.

We may ask for photographs showing the problem so that we can investigate.

Where appropriate, we will arrange a repair, replacement or refund in accordance with your legal rights and our Returns & Refunds Policy.

Promotions and Discount Codes

From time to time we may offer promotional prices, discount codes or special offers.

Unless otherwise stated:

• Discounts cannot be exchanged for cash.
• Only one discount code may be used per order.
• Discounts must be applied before checkout is completed.
• Promotions may have an expiry date or other stated conditions.

We reserve the right to withdraw or amend a promotion where there has been an obvious error, misuse or technical problem.

Gift and Product Safety

Customers are responsible for following any care, washing, age or safety instructions supplied with a product.

Products intended as decorations or keepsakes should only be used for their intended purpose.

Children should be appropriately supervised when using products containing small parts, cords, ribbons, beads, keyrings or other components that may present a hazard.

Where a product carries specific age or safety guidance, that guidance should always be followed.

Intellectual Property

Unless otherwise stated, the content of the Clark’s Creations website, including our branding, photographs, product descriptions, graphics and original designs, belongs to Clark’s Creations or is used with appropriate permission.

You may not reproduce, sell, distribute or commercially use this material without prior permission.

Third-party artwork or licensed designs remain the property of their respective rights holders.

Your personal information is handled in accordance with our Privacy Policy.

Where personalisation requires names, photographs or other information, we use that information to produce and fulfil your order and for related customer service purposes.

Website Availability

We aim to keep our website accurate and available, but we cannot guarantee uninterrupted access at all times.

We may occasionally update, suspend or temporarily close parts of the website for maintenance, business holidays, stock changes or other operational reasons.

Our Responsibility to You

Nothing in these Terms of Service excludes or limits any responsibility that cannot legally be excluded, including your statutory consumer rights.

We are responsible for losses that are a foreseeable result of us breaching these terms or failing to use reasonable care and skill.

We are not responsible for losses that could not reasonably have been foreseen when the contract was made.

If you are purchasing as a consumer, we are not responsible for business losses such as loss of profit, revenue or business opportunity.

Events Outside Our Control

We will not be responsible for delays caused by circumstances outside our reasonable control, such as severe weather, postal disruption, courier delays, power or internet outages, supplier disruption or other unexpected events.

If this happens, we will take reasonable steps to minimise the effect and keep affected customers informed where appropriate.

Changes to These Terms

We may update these Terms of Service from time to time to reflect changes to our products, website, business practices or legal requirements.

Any changes will apply to future orders and will not remove rights you already have in relation to an existing order.
